"TX Law prevents"

FYI - regarding my suggestion we adopt the Florida method ot Compliance Boards for illegal sign enforcement:

Mr. Cameron:

Thank you for submitting your email regarding the possibility of using a Compliance Board for non-compliance to city zoning regulations. A Board having the power to assess civil penalties could certainly be useful in attaining compliance to the City of Austin's zoning regulations.

State Law does give the ability to create a commission for review of
enforcement cases on dangerous and sub-standard housing. A Building and Standards Commission currently hears all non-compliance cases where substandard or dangerous structures are involved and this process has proven very successful.

Approximately two years ago, when the City of Austin explored the
possibility, it was determined by City Law Staff that State Law did not support the creation of such a Board in regards to zoning regulations. Staff has continued to forward non-compliance cases to Municipal Court for zoning violations.

Again, thank you for your concern.

Sincerely,

William E. Rhodes, P.E., Director
City of Austin, Solid Waste Services

an Austin Sign Ranger

"City Law Staff that State Law did not support the creation of such a Board"

I don't think that any of us in Austin have a doubt as to whom
this refers, nor are we surprised with the results.
